GATS and State-Level Regulatory Powers

GATS rules prohibit WTO Members from maintaining or adopting measures that require service providers to operate through joint ventures or otherwise restrict the manner in which they provide a service.  This may conflict with public utility regulation in Idaho.  Furthermore, transparency requirements under GATS may conflict with Idaho's law that acquisitions of power companies be "consistent with the public interest."
